  • Americans With Disabilities Act

    Programs for Students With Disabilities Under Section 504 of the Rehabilitation Act of 1973 And The Americans With Disabilities Act of 1990 And The Americans With Disabilities Act Amendments of 2008

    Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990 and its amendments prohibit discrimination against persons with a disability in any program receiving federal financial assistance. Section 504/ADA and its amendments defines a person with a disability as anyone who: has a mental or physical impairment which substantially limits one or more of a person's major life activities; has a record of physical or mental impairment; or is regarded as having a physical or mental impairment.

    Schools have responsibilities to provide accommodations, modifications and necessary services for eligible individuals with disabilities.

    USD #463 acknowledges its responsibility under Section 504/ADA and its amendments to avoid discrimination in policies and practices regarding students, patrons and personnel. No discrimination against any person with a disability shall knowingly be permitted in any program or practice within USD #463.

  • It is the intent of Udall Public Schools to comply with both the letter and spirit of Executive Order 11246, Title II of the Education Amendments of 1976, Title VI of the Civil Rights Act of 1974, Equal Employment Opportunity Act Amendments of 1972, Title IX Regulation Implementing Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, Age Discrimination Act of 1975, and all other Federal and State laws/regulations and school procedure/policies.

  • The Family Policy Compliance Office, an office within the United States Department of Education, is the agency which oversees compliance with the Family Education Rights and Privacy Act (FERPA) and the Protection of Pupil Rights Amendment (PPRA).  The following documents relate to these statutes.

  • Title I Parents Right to Know

    Udall Elementary is a Title I school, and as such must meet federal rules related to teacher qualifications as defined in ESEA-Every Student Succeeds Act. These rules allow you to learn more about your child’s teacher’s training and credentials. We are happy to provide this information to you. 

    At any time, you may ask:

    • Whether the teacher met state qualifications and certification requirements for the grade level and subject he/she is teaching,
    • Whether the teacher received an emergency or conditional certificate through which state qualifications were waived, and
    • What undergraduate or graduate degrees the teacher holds, including graduate certificates and additional degrees, and major(s) or area(s) of concentration.
    • Whether your child receives help from a paraprofessional while at school. And if your child receives this assistance, we can provide you with information about the paraprofessional’s qualifications.

    Our staff is committed to helping your child develop the academic knowledge and critical thinking he/she needs to succeed in school and beyond. That commitment includes making sure that all of our teachers, aides, and paraprofessionals are highly skilled.  Please contact your child's school principal for further information, questions, or concerns.
